sales policies

BERNACHON's current Sales Policies apply to all purchase transactions. Your placement of an order indicates your acceptance of these terms and conditions. No additional, inconsistent or contrary terms shall become part of this agreement unless specifically accepted in writing by BERNACHON.


Order
Orders by phone are not accepted. Only orders placed by mail, email or fax will be honored. Regardless of the delivery time, orders will only be honored after reception of:

1. Your visit card which will be sent with the parcel.

2. The list of addressees with names, complete addresses and valid telephone numbers. We decline any responsibility for mistakes in those addresses (cost of re-shipping at your expenses).

Your order will be shipped once your payment is received and accepted.


Assortment and freshness guarantee
Our chocolates are handcrafted and produced in limited quantity. Should an ordered item run out of stock, BERNACHON reserves the right to modify the assortment to prevent delivery delay. Expiration dates are displayed on packages in order to guarantee the freshness of our products. Orders cannot be returned nor exchanged.

In order to maintain the freshness of chocolates, any order placed between Thursday (12.00am) and Monday will be shipped on Tuesday.


Delivery time
France
Your order will be dispatch after a minimum of 5 days upon receipt of invoice.

Christmas: We guarantee delivery before Christmas for invoices received on the 10th December at the latest.

New Year's Eve: We guarantee delivery before New Year's Eve for invoices received on the 20th December at the latest.

This guarantee cannot be applied in case of postal strike.

Parcels can be delivered via special express carriers upon customer request.

Products can be delivered by taxi cab drivers or by a special delivery boy within the COURLY.


Pricing
All prices include sales taxes. Shipping costs are not included.


Payment
Private customer: payment with order.
Professional customer: 50 % payment with order and 50 % payment upon receipt of the invoice. In the event of payment default, in accordance with Act 92-1442 of 31 December 1992, as amended, and as a penalty clause, the buyer shall be liable by operation of law to pay a late payment penalty calculated by application of an interest rate equal to 1.5 times the statutory interest rate to the entire outstanding amount.


Litigation
Any litigation is within the competence of the commercial court of Lyon. Sales policies are expressly governed by French Law.
